Terms of Service
1. This agreement
These terms are an agreement between [company legal name] ("we", "us") and the clinic, doctor or organisation that subscribes to 961doctor ("you", "the clinic"). By creating an account or using 961doctor you accept these terms and our Privacy Policy. If you accept on behalf of a clinic, you confirm you are allowed to bind it.
2. Who can use 961doctor
961doctor is for licensed healthcare practitioners and the clinics where they work, and for the staff they authorise. You must be at least 18 years old and allowed to practise or work in healthcare where you are.
3. Accounts and security
- The person who signs the clinic up becomes its owner and admin. Admins add doctors (each on the plan the clinic chooses) and other staff, choose their roles, assign assistants to doctors, and manage the clinic's locations, services and prices. Doctors set their own working hours and can add their own assistants.
- New accounts and password resets come with a one-time temporary password that must be changed at first sign-in.
- Each person uses their own account. Do not share passwords. Tell us at once if you think an account has been misused.
- You are responsible for what happens under your clinic's accounts, and for deactivating people who leave.
4. The clinic's responsibilities
- You decide what patient information to store and you are responsible for having a lawful basis for it, including patients' consent where the law requires it.
- Before sending WhatsApp or email messages to a patient, you must have their agreement. 961doctor records this choice and stops messages to patients who opt out.
- You keep the information you enter accurate, and you follow the medical-records, professional and privacy rules that apply to your practice.
- Before storing real patient information, the clinic signs our data processing agreement.
5. Not medical advice
961doctor is a record-keeping and communication tool. It does not give medical advice. Allergy warnings, medicine lists and suggested doses are aids based on the information entered; they are not complete or guaranteed. Clinical decisions, prescriptions and their consequences remain the responsibility of the treating practitioner.
6. Plans, trials and billing
- Plans are priced per doctor, in US dollars, and the clinic pays one bill for all its doctors, for one or more months or for a year at a time (12 months for the price of 10). Current plans and their limits on locations, assistants and WhatsApp messages are shown on our pricing section.
- Each plan includes a number of assistants per doctor. Where the plan says so, each extra assistant is a one-time fee added to the clinic's next payment.
- New subscriptions start with a 14-day free trial. [State whether a card is needed to start the trial and what happens when it ends.]
- Payments are made directly to 961doctor, and each payment gets a numbered receipt. Paid time continues from the end of the trial or of the last payment. Nothing is charged automatically.
- Prices exclude taxes unless stated. [VAT treatment, per your accountant.]
- If we change prices, the change applies from your next renewal, and we tell admins by email at least [30] days before.
- If you reach a plan limit, for example the monthly WhatsApp message allowance, you can move to a larger plan. [State whether extra messages are blocked or charged.]
7. Failed payments and suspension
If the paid time or the trial ends without a payment, the clinic has a grace period of 7 days during which everything keeps working and staff see a reminder. After that the clinic becomes read-only: staff can still see and print records, but cannot add or change them. No data is deleted because of non-payment, and paying the balance restores full access at once.
8. Cancellation and refunds
- The clinic admin can cancel a subscription at any time. It stays active until the end of the period already paid, then becomes read-only.
- Records remain available for export for [period] after cancellation and are then kept or deleted as described in our Privacy Policy and as medical-records law requires.
- [Refund policy: for example, no refunds for partial months, except where the law requires.]
9. WhatsApp and email messages
- Messages are sent from the clinic's verified WhatsApp Business number using templates approved by Meta, and must follow WhatsApp's Business and Commerce policies.
- Meta limits how many new conversations a number can start each day; the limit grows with good message quality. We are not responsible for delays or blocks caused by Meta.
- Patients can reply STOP to stop messages. Do not use 961doctor to send marketing or messages unrelated to the patient's care or payments.
10. Acceptable use
You agree not to:
- use 961doctor for anything unlawful, or to store information you have no right to hold;
- try to access another clinic's information, test or break our security without written permission, or overload the service;
- copy, resell or reverse-engineer the service, except where the law allows it;
- upload malicious code, or misuse messaging to send spam.
11. Your data
The clinic owns the information it puts into 961doctor. We use it only to provide the service as described in our Privacy Policy and the data processing agreement. You can export your records at any time, including while your account is suspended or cancelled.
12. The live demo
The live demo on this website runs in your browser with invented sample data. Nothing you enter is saved or sent to us. Do not enter real patient information in the demo.
13. Availability and changes
We work to keep 961doctor available and to back it up, but we do not promise it will be uninterrupted or error-free. [Service level, if any.] We may improve or change features; if a change removes something important you rely on, we will tell admins in advance.
14. Intellectual property
We own 961doctor, its software, design and name. Your subscription gives you the right to use it for your clinic while the subscription is active. Feedback you send us may be used to improve the service.
15. Liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data caused by events outside our reasonable control, and our total liability for any claim is limited to the amount you paid us in the [12] months before the claim. Nothing in these terms limits liability that cannot be limited by law. [Review with counsel.]
16. Ending this agreement
You can end this agreement by cancelling your subscription. We may end or suspend it if you seriously breach these terms and do not fix the breach within [14] days of our notice, or immediately where needed to protect patients, other clinics or the service. Sections on your data, liability and governing law continue after the agreement ends.
17. Governing law
These terms are governed by the laws of [country], and disputes go to the courts of [city].
18. Changes to these terms
We may update these terms. We will post the new version here, update the date at the top, and tell admins by email at least [30] days before a significant change takes effect. Continuing to use 961doctor after that means you accept the new terms.
